Supreme Court Hears Arguments in Tower Case

January 20, 2005.  The U.S. Supreme Court heard oral arguments yesterday in a case that has the potential to significantly impact how difficult it is for wireless operators to gain approval for new tower sites.  In this case a lower court has ruled that the city of Rancho Palos Verdes, California wrongly denied a ham-radio operator a permit to erect a tower for his antenna in his backyard.  The ham-operator has appealed to the Supreme Court to recover attorneys' fees and damages in excess of $15 million, which is more than the city's annual operating budget.

If the Supreme Court was to rule that the plaintiff could recover attorneys' fees and damages, it would undoubtedly cause other cities to hesitate about apposing new towers in order to appease their citizens.

Lookout Mountain Controversy Continues with New Health Report

The Colorado Department of Public Health and Environment has issued a report that there is no conclusive evidence linking adverse health effects on Lookout Mountain residents with the broadcast antenna farm located there.  This is just the latest development concerning the antenna farm on Lookout Mountain, which serves the Denver market.

The controversy over the construction of a new shared television tower  has raged for several years. The new common DTV antenna tower is to be shared by the members of the Lake Cedar Grove consortium, which includes four local TV stations.  The group's plan was approved last year, but a citizens' group won a court order staying the approval pending more information on possible health effects.  In September 2004, shortly after the Department of Public Health and Environment issued its findings,
Commissioners in Jefferson County, CO, approved the tower and a 20,000-square-foot equipment building that will occupy slightly more than eight acres of an 81-acre site.

After two additional hearings on the issue, which was ordered reopened by a court ruling handed down in March, commissioners again voted 3-0 to approve a plan to replace three large existing towers and a number of smaller ones with a single 730-foot main tower on the mountain overlooking Golden, Colorado.
